How the Feds are Reacting to pot Legalization

Posted on November 8, 2012 at 10:42 am by David Downs in LegalPolitics

How are the authorities reacting to pot legalization in Washington and Colorado? Well, Attorney General Eric Holder says “I don’t know [if I’ll be coming back for four more years]“, according to a newly released video of Mr. Holder speaking at a law school. Many see that as the warm-up before the departure of the embattled AG, who oversaw a largely ineffective crackdown on medical marijuana.

Kristen Gwynne at AlterNet does a great round-up of all other responses today, noting that the governor of Colorado said, “The voters have spoken and we have to respect their will. This will be a complicated process, but we intend to follow through. That said, federal law still says marijuana is an illegal drug so don’t break out the Cheetos or goldfish too quickly.” . . . Does legal marijuana in the US really mean trouble for Mexican drug cartels?

By , Staff writer / November 8, 2012

A look at the numbers.

It has long been a popular argument among campaigners for reform of America‘s marijuana laws that legalization would strike a major blow against the violent Mexican drug gangs that have brought so much misery to parts of that country and, increasingly, along the US border.

The logic is simple. Marijuana smuggling is a major earner for drug gangs, so a legal crop in the US would have a dramatic impact on their operations, lowering the amount of money available to them to bribe cops and hire killers south of the border. . . . Read Complete Report

Drug Smuggler Speaks Out About Incarceration and Marijuana | Richard Stratton | TEDxFultonStreet

Published on Nov 12, 2015

Richard Stratton’s education helped him to vacate a coercively harsh sentence, and now he speaks out to help others who are behind bars unjustly. The irony is not lost on Stratton, that recent cannabis legislation has legalized many of the activities for which people are still locked up. He offers a unique glimpse into the mind of an underworld leader, an award-winning writer and filmmaker, and a human rights advocate. Richard Stratton is a former international cannabis smuggler, CEO of a multi-million dollar operation. Arrested in 1982, he was convicted under the “Kingpin Statute” and sentenced to 25 years in federal prison.

Florida: Top Lawyer & #1 Supporter of Medical Marijuana filed a lawsuit to overturn the state’s ban on smoking medical marijuana

John Morgan and his firm are one of the best known “Peoples Law firms” in the state and has become a local hero in his support of making medical marijuana available to Florida Residents.  Most of the money spent in the legalization movement has come from him personally.

Due in large part to Mr. Morgan’s involvement in our last election 71% of Florida’s voters voted “yes” on legalizing medical marijuana and it became added to our state constitution.

However as has been happening all over our country Florida Legislatures have forgotten that they are in Tallahassee to perform the will of the people and are trying every way they can think of to stop this State Constitutional Amendment.  Mr. Morgan is our champion in the fight to stop this movement. . . . Your Editor Dennis Crenshaw

A Letter from John Morgan ESQ. to your editor Dennis Crenshaw Dated 7/6/17

Dennis,

Today, I am filing a lawsuit to overturn the state’s ban on smoking medical marijuana, which everyone knows is in direct contradiction to the constitutional amendment we passed.

The ban is unconstitutional, and as promised, we are going to take it to the courts and win.

Getting anything passed through the legislature, as you know, was an accomplishment. Tallahassee politicians often forget who the they are working for.

know who I am working for: The patients and all of you who have fought with us for years to make sure those patients have access to the medicine they need.

Now, thanks to our collective efforts, most patients will get that access via certain types of marijuana. But it’s not enough and not everything the voters passed.

So we start the new fight today in the courts. And we will continue to fight anywhere and any place where the will of the voters is attempting to be side-railed or ignored.

We are unified in this fight and we will bring our cause to a complete and unasterisked victory soon.

Please help us fund this fight and bring even more forces to bear against those that would stand against patients by donating here.

Believe,

John Morgan

Prison Cell Stillwater SOURCE Public DomainBlacks Are Singled Out for Marijuana Arrests

Black Americans were nearly four times as likely as whites to be arrested on charges of marijuana possession in 2010, even though the two groups used the drug at similar rates, according to new federal data.

This disparity had grown steadily from a decade before, and in some states, including Iowa, Minnesota and Illinois, blacks were around eight times as likely to be arrested. During the same period, public attitudes toward marijuana softened and a number of states decriminalized its use. But about half of all drug arrests in 2011 were on marijuana-related charges, roughly the same portion as in 2010. . . . Read Complete Report

New York General Assembly approves medical marijuana bill

The New York General Assembly yesterday approved a bill allowing medical marijuana use in the Empire State.

Assembly Bill 6357 was voted in with a 95-38 vote. The discussion now moves over to the state Senate in the next few weeks, which takes up the nearly identical Senate Bill 4406. If approved, the bill would allow for qualifying patients to receive a doctor’s recommendation to use cannabis. Patients would be allowed to possess up to 2.5 ounces purchased at one of several state-regulated medical marijuana dispensaries.Overwhelmingly, New Yorkers favor medical marijuana legislation. A recent Sienna Research Institute Poll showed that 82 percent of voters agree that physicians should be able to recommend cannabis. . . . Read Complete Report

Louisiana-thumb SOURCE Toke of the Town Fair UseLouisiana bill removing marijuana from three-strikes laws, lessening penalties approved by House

An amended version of a bill that would end Louisiana’s draconian three-strikes law for some marijuana crimes has finally made its way through the house.

But it could be a tight squeeze to get the bill through. The Louisiana Senate adjourns next week, leaving little time to have the bill heard, debated and voted on before the politicians leave Baton Rouge for the year House Bill 103, which we’ve written about in the past, originally would have capped felony marijuana conviction sentences at five years. That version failed to clear the House floor last week, so authors amended it to make the penalties a little more harsh. . . . Read Complete Report

States together spent somewhere around $3.6 billion enforcing marijuana possession laws in 2010, according to a new study by the American Civil Liberties Union, entitled “The War On Marijuana In Black and White.” That’s the authors’ “best estimate,” though approximations using different methodologies put the cost as high as $6 billion and as low as $1.2 billion.

[Inside] Tha Jackal’s Head+Hard Copy: Marijuana Support ~ Hip Hop ICONS Layzie Bone & Thin C on the “Hemp” Bible, “The Emperor Wears No Clothes”

From [Inside] tha Jackal’s Head: 5/31/2013

Hip Hop legends Layzie Bone of super rap group Bone Thugs, and Harmony, and fellow Mo Thugs artist Thin C give major props to the late Jack Herer who wrote the book “The Emperor Wears No Clothes.” If you are not familiar with Jack Herer I suggest you check out the video below this one.

The Emperor Wears No Clothes is a book written by Jack Herer. Starting in 1973, Jack Herer took the advice of his friend “Captain” Ed Adair and began compiling tidbits of information about cannabis and its numerous uses. After a dozen years of collecting and compiling historical data, Herer first published his work as The Emperor Wears No Clothes in 1985. The eleventh edition was published in November 2000, and the book continues to be cited in cannabis rescheduling and re-legalization efforts.

The book, backed by H.E.M.P. (America), Hanf Haus (Germany), Sensi Seeds/Hash, Marihuana & Hemp Museum, Amsterdam, (Netherlands), and T.H.C., the Texas Hemp Campaign (America), offers $100,000 to anyone who can disprove the claims made within. Quoting from the book’s back cover:

“If all fossil fuels and their derivatives, as well as trees for paper and construction were banned in order to save the planet, reverse the Greenhouse Effect and stop deforestation; then there is only one known annually renewable natural resource that is capable of providing the overall majority of the world’s paper and textiles; meet all of the world’s transportation, industrial and home energy needs, while simultaneously reducing pollution, rebuilding the soil, and cleaning the atmosphere all at the same time… and that substance is — the same one that did it all before — Cannabis Hemp… Marijuana! . . . Jack Herer The Emperor Wears No Clothes

The title of the book alludes to the classic fairy tale “The Emperor’s New Clothes” by Hans Christian Andersen. Herer uses Andersen’s story as an allegory for the current prohibition of cannabis.

European experts on hemp, like Dr. Hayo M.G. van der Werf author of the doctoral thesis Crop physiology of fibre hemp (1994), criticized the book for containing some inaccuracies.

The Internet is up in smoke in anticipation of 4/20. Practically a national holiday for college kids and aging hippies alike, 4/20 celebrates the consumption of cannabis, Mary Jane, pot, whatever you like to call it. According to Wikipedia, the holiday got its origins in 1971 from a group of teenagers in San Rafael, Calif., who liked to meet up at 4:20 p.m. to get high. As a result, 4/20 became their secret code word and 40 years later, the code word for an entire nation.
