An acquaintance reminded me of this the other day. I read it years ago while looking into the history of the Civilian Marksmanship Program, which was a direct outgrowth of the Dick Act aka the Militia Act of 1903. By Acts of Congress established a three level defense for our nation and provided a legal boundary of national, state, and private citizen militia where the national command authority had control over the Army, Navy, and Marines. There was not yet an Air Force and the Coast Guard then was part of the Treasury Department. The President could call up the National Guard for self defense purposes, but could not order their deployment overseas. The governors could call up the National Guard for emergencies inside their state. The Governors could also call up the unorganized militia, but the President could not. That’s right, the Militia Act of 1903 established by law provisions for an “unorganized militia” in each of the various states. The proposal could lead to the most significant move on guns in 20 years, but one regulation highly coveted by gun control advocates was notably missing: a ban on assault weapons.

Will he or won’t he?

That’s what’s on the minds of gun owners and lobbyists and activists on both sides of the gun control debate – will President Barack Obama call for an assault weapons ban in the wake of a spate of deadly mass shootings or not?

Politically, such a ban doesn’t stand much chance of passing Congress, with a Republican House. It’s not even clear a ban would pass the Senate, despite its Democratic majority.

Occupy LA movement activists are suing the city of Los Angeles for their civil rights violations. In November 2011 some protesters were detained while staging an eight-week-long encampment at City Hall teamed up with the Occupy Wall Street movement. Police responded by performing a sweep that affected nearly 300 demonstrators. The group has now filed an A class lawsuit accusing the law enforcement officials of violating human rights and mistreating the protesters in penitentiary. One of the named plaintiffs in the case, Michael Prysner joins us for more.

On November 30th last year around 300 protesters were arrested at the Los Angeles City Hall after being camped out in the vicinity for over two months. An estimated 1400 police officers showed up and blazed through the encampment in what protesters are now calling a “shock and awe” attack on their rights. Bailiffs cleared out anti-capitalist activists and their belongings from a site underneath HSBC bank’s Asian headquarters in Hong Kong on Tuesday – ending one of the global Occupy movement’s longest-running encampments. Skirmishes broke out after bailiffs and bank guards arrived in the morning to clear out the activists, who had ignored a court order requiring them to leave by 27 August. Some were carried or dragged away and taken outside a perimeter, where they were let go. An activist was designated as a terror suspect put on the terrorism watchlist, which was used to prevent him from protesting at the week’s DNC in Charlotte.

Activists James Tyson was shocked when he was giving an extremely high $10,000 bail after being pulled over on his way to protest at  the Democratic National Convention in Charlotte.

Court documents show prosecutors were able to get such an unreasonably high bail set because they argued he was a dangerous person listed on the Department of Homeland Security’s terrorism watch list.

Tyson’s only two previous  run-ins with law enforcement  were for fishing out of season and driving while impaired.

Even more ostensible is prosecutors argued that Tyson be held in jail without bail until after the DNC was over. . . . Read Complete report

Obama Demands Court Uphold His “Right” To Ignore Constitution

Obama’s Department of Justice is demanding a federal judge dismiss the injunction with which she sought to uphold the constitutional rights of the American people.

On May 16th, federal judge Kathleen Forrest granted a preliminary injunction to plaintiffs in a lawsuit filed against Barack Obama and the National Defense Authorization Act of 2012 (NDAA), striking down those sections of the Act that provide the president the power to indefinitely detain American citizens without benefit of their 5th and 6th Amendment rights.

Under the terms of the Act, Obama had been given exclusive authority to direct members of the US military to arrest and imprison anyone he believed to have “substantially supported” al Qaeda, the Taliban, or “associated forces.” When pressed by plaintiff’s attorneys about the practical extent of this authority, government lawyers admitted “…the NDAA does give the president the power to lock up people like journalist Chris Hedges and peaceful activists,” admitting that “…even war correspondents could be locked up indefinitely under the NDAA.” . . . After 15 days in jail, 31 year old Danny L. Johnson, Chicago NATO protestor and member of Occupy Los Angeles and Occupy Walk USA, was released the evening of Tuesday, Aug. 14 from Cook County jail on an ankle bracelet home arrest e-monitoring program. Activists in Chicago and around the country helped post his bail Monday, Aug. 13, and establish a Chicago address for Johnson to be released to. Johnson returned to Chicago Monday, July 30 to turn himself in after learning that dropped charges acquired when was arrested in Chicago for protesting the NATO Summit earlier in the year, were reinstated by Cook County State Attorney Anita Alvarez through a grand jury indictment. On June 29 a bench warrant was issued for Johnson’s arrest on two felony counts of battery on an officer -although original dropped charges were one felony count of battery on an officer and one misdemeanor count of obstruction of traffic.

Some are saying the charges were re-filed by Alvarez under pressure from Mayor Rahn Emanuel, and, according to local Chicago activists Adesina, as part of a “political agenda to use every avenue available to criminalize NATO protestors.” . . . Read complete Report
